Through a resolution dated August 30, the Chamber Specialised in Elimination of Bureaucratic Barriers (SEL) of the National Institute for the Defence of Competition and the Protection of Intellectual Property (INDECOPI), declared as legal the requirements established by the Ministry of Health (MINSA) regarding advertising warnings for food and nonalcoholic beverages with octagons with the phrase "HIGH IN" for sugar, sodium, saturated and trans fats.
In February 2020 the Commission of Elimination of Bureaucratic Barriers (CEB) of INDECOPI resolved that it was unlawful for MINSA to regulate the advertising of the octagons; it was declared that the requirements proposed by MINSA were illegal bureaucratic barriers on the grounds that it was not the role of this entity to regulate advertising. With the current resolution, the Chamber revoked Resolution 0072-2020/CEB-INDECOPI from CEB and declared the complaint to be unfounded.
